In 1995 the US Food and Drug Administration (FDA) asserted that: "Nicotine in cigarettes and smokeless Tobacco products is a drug and these products are nicotine delivery devices under the Federal Food, Drug, And Cosmetic Act" thereby bringing tobacco within FDA jurisdiction. This was the start of a legal battle for many years on whether cigarettes and smokeless tobacco should be included under FDA jurisdiction. From the FDA Consumer Magazine October 1996.
